Coal scam: Court directs CVC to clarify stand on closure report

The court’s direction came after CVC Director Rashmi Sinha, who appeared before it, said the commission has sought comments from the Ministry of Coal (MoC) regarding the agency’s closure report in the matter in which an FIR was lodged on the basis of CVC’s reference.

During the hearing, Special CBI Judge Bharat Parashar told Sinha that the court had issued <g data-gr-id="32">notice</g> to CVC Director to know the stand of commission as an institution on the issue. “As per the Supreme Court directive, CVC has <g data-gr-id="30">supervisory</g> role over CBI and all the FIRs in coal scam cases have been registered on the <g data-gr-id="20">recomendation</g> of CVC.

“Primary objective of issuing notice to CVC director is to know whether the institution (CVC) has anything to say on the closure report filed by CBI and whether CVC can be of any help to this court in considering the closure report,” the court said.

It further said that the law mandated the court to issue <g data-gr-id="24">notice</g> to the complainant, on whose complaint an FIR has been <g data-gr-id="26">registered,</g> if the probe agency files <g data-gr-id="25">closure</g> report.

“I have not called you (CVC Director) in your personal capacity. If you have to say something you 
can say...As an institution, you will have to clarify your stand,” the judge said.

CBI to argue on Koda’s plea to summon Manmohan on Sept 28 
CBI would make its stand clear on September 28 before a special court on the application filed by ex-Jharkhand Chief Minister Madhu Koda seeking summoning of former Prime Minister Manmohan Singh and two others as accused in a coal block allocation scam case. Special public prosecutor R S Cheema, who was scheduled to argue on Koda's plea on Tuesday, requested Special CBI Judge Bharat Parashar that another date be given for arguments as he would take an hour to address his arguments, as the matter was taken up in the afternoon. The judge later fixed the next date of hearing on September 28.
