Civic centre in ownership spotlight again

The ownership dispute of the tallest building in the city, Civic Centre, has now reached new heights – the ‘red book’, the Delhi Municipal Corporation (DMC) Act, is being referred to now by the disputing MCDs.  In response to a notice of property tax and rent by North MCD the South MCD quoted several provisions of the DMC Act and decisions of Delhi government claiming its ownership rights on the building.

South MCD has also denied the demand of Rs 137 crore by North MCD and demanded fare share in the earnings of the buildings. In his letter, Singh has hinted that South MCD could charge rent and also property tax from North MCD. ‘There is a need to get the issue of the ownership of both the corporations decided in respect of Civic Centre before any issue of rental or property tax is raised by either of the corporation,’ said said B N Singh, assessor and collector of South MCD in his reply to North MCD’s notice on property tax. He further said, ‘According to Section 120 of the DMC Act, the property tax primarily depends on ownership and share of the ownership. and according to Section 116 E covered space cannot be determined without certifying the ownership of the building.’

The property tax department of the North MCD has send notice to South MCD on 23 January quoting provisions of Section 120 (1) (d) of the DMC Act. ‘Further, the properties of the municipal corporations are exempted from tax under section 115 of the DMC Act,’ added Singh.
