KMC to strictly enforce completion certificate rules for builders

Kolkata: Following a Supreme Court order, Kolkata Municipal Corporation (KMC) will take tough measures to strictly enforce the rule of obtaining a completion certificate (CC) by developers before shifting in people.
Mayor Firhad Hakim has said that the civic body will be compelled to disconnect water supply lines to such constructions if the promoters don’t apply for the
completion certificate.
The Mayor said that recently the Supreme Court gave an order directing that during permission of building plan, the applicant will give an undertaking that possession will only be given only after obtaining a completion certificate. Generally, developers registered under RERA give an undertaking to the body for the same but now this apex court order has clearly mandated that all developers will have to give such undertaking before shifting people into the flats.
The Mayor said the civic body has already been instructed that such certificates be given to the developers in three days after inspection. He also said that the apex court order clearly stated that if there is any deviation from the sanctioned building plan the certificate will not be given until it is rectified.
All necessary service connections must be given after issuing of CC, the court’s direction said. The Mayor said without the CC neither can the KMC give the water supply connection nor can the CESC give power connection to the constructions. Even temporary lines will be disconnected.
Further, the Mayor said no licence for trade will be given to any unauthorised building irrespective of whether it’s residential or commercial building. He said in case of deviation in the building plan, such is to be dealt with within 90 days of the application of appeal for revision by the developers/owners regarding non-issuance of CC. “KMC will deal with it within 15 to 30 days,”
the Mayor assured.
He also said according to court order, no banks and financial institutions would be able to sanction a loan without verifying whether the
CC was obtained.
Hakim said KMC is already curbing illegal constructions. “We have compiled a roster for our building department engineers for conducting inspection. If there is lapse, they can be suspended,” the mayor said.
