Encroachers must free Santragachi Jheel area: HC

Kolkata: Dismissing their petition, the Calcutta High Court on Monday directed the encroachers of Santragachi Jheel to approach National Green Tribunal (NGT) with their prayer for adequate time for relocation.

The bench of Justice Amrita Sinha was moved by the encroachers alleging that the Railways is not taking steps to provide them with accommodation during the eviction drive. They contended that the NGT had mentioned in its order to rehabilitate the encroachers.

The petitioners are occupying the north portion of the waterbody and alleged that they were not served any eviction notice or given a chance of hearing.

However, the court observed there were no such orders from the NGT. The court said that Santragachi Jheel is required to be protected. This is where the migratory birds come during winter.

The court directed the encroachers to approach the NGT for relief.

The Railways submitted that the encroachers have built temporary settlements and even pucca houses. They are selling household

articles there.

“It appears that the action for removal of unauthorised occupants is being taken in compliance with the direction passed by NGT. It will be open for petitioners to approach NGT for necessary

relief,” court said.

Santragachhi Jheel is a large lake located next to the Santragachi railway station in Howrah. This lake attracts a large number of migratory birds in the winter months, particularly in December and January. Last year, the NGT had directed the state to make pollution free. A committee was formed comprising Railway officials and representatives of several state government agencies. The Railways was directed to free the lake area of encroachment.
