As CBI dithers, Shah worries ‘almost’ over

The CBI is undecided whether or not to move a higher court against the discharge of BJP President Amit Shah by a trial court in fake encounter cases. With just one week left to appeal against Shah’s discharging by a Special CBI court in the Sohrabuddin Sheikh and Tusliram Prajapati fake encounter cases on December 30, the CBI said, “it is still examining the matter”.

Though 90 days since the order was pronounced lapsed on Monday, the CBI said it would decide on its move in the next few days “as the period of appeal starts from the day a copy of the order is made available”. In these cases, the order was made available a week after it was pronounced. So, the investigative agency has some time to think over their course of action. “Ninety days are not yet over and the matter is under examination,” said a CBI spokesperson.

On December 30, 2014, a special CBI court in Mumbai had discharged Shah from the cases, citing that they had “political undertone”. “I found substance in the main contention made by the applicant (Shah) that he was involved in the case by the CBI for political reasons,” special CBI Judge MB Gosavi said, discharging Shah. At that time, CBI Director Anil Sinha had said that the agency would study the court order before its next course of action.

Meanwhile, lawyers representing families of the deceased said they were planning to file an appeal against the court’s order. Speaking to Millennium Post, Sohrabuddin’s brother Rubabuddin Sheikh said, “The CBI should appeal against Shah’s discharge. My lawyers are planning the next course of action.”
