Apex Court orders CBI probe in Vyapam scam

A bench headed by Chief Justice H L Dattu clarified that all cases related to the massive admission and recruitment scandal will be transferred to the CBI from Monday and the agency will file its report before it on July 24.

The bench was critical of the Madhya Pradesh High Court, which had refused on Wednesday deferred hearing on the ground that the matter was before the apex court.
The response came after Attorney General Mukul Rohatgi said the state has already moved the high court for CBI probe and the matter was fixed for July 20.
“The High Court wants to wash off its hand. On CBI enquiry, instead of doing that, they are now saying that ball is in the Supreme Court,” the bench observed.

Before handing over the probe to the CBI, the apex court took on record the submission of the Attorney General, who on behalf of the MP government, said that the state has no objection on transferring the investigation of cases relating to Vyapam scam to CBI and the cases related to the deaths of people allegedly related to the scam for free and fair probe.
“The Attorney General (AG) on instruction states that MP govt has no objection whatsoever for transferring the investigation of criminal cases relating to Vyapam scam to the CBI and the cases related to deaths of those allegedly connected with the scam for free and fair probe.
“We appreciate the stand of the AG. In view of the above we transfer investigation of all criminal cases relating to Vyapam scam and deaths of people allegedly related to it, to CBI for free and fair probe,” the bench also comprising Justices Arun Mishra and Amitava Roy said.
Congress has alleged that 49 persons linked to the Vyapam scam have died under mysterious
circumstances, a charge refuted by the state government. The official figure is 25 which the state government says includes suicides, accidents and some other unnatural deaths.
Senior advocates Kapil Sibal, Abhishek Singhvi and Vivek Tankha, appearing for various petitioners, questioned the way the Madhya Pradesh High Court dealt with the matter and expressed apprehension on the future course. At this stage, the bench interrupted them saying that since the Apex Court was now passing an order, how can the High Court proceed.

The bench also refrained from making any remarks on the Governor when Sibal said that Yadav should demit office to maintain its dignity.
“We are not going to say anything on it,” it said. Sibal drew the attention of the bench to the May 5 order of the High Court by which the FIR against the Governor was quashed on the ground that “he enjoyed constitutional immunity under Article 361 (2) of the Constitution”.
“It saddens that Madhya Pradesh Government has come to the Supreme Court. Senior dignitaries are involved. All principles of criminal procedure have been compromised. The High Court quashed the FIR on the ground that Governor enjoys protection under Article 361 (2),” he submitted while adding that Yadav’s name was mentioned at serial number 10 in the list of the accused.
Narrating in detail the sequence of events that led to the surfacing of Governor’s name in the scam, he said a special report was placed before the High Court in a sealed envelope on February 20 this year and even the stand of the Union of India was that the action of lodging FIR “does not offend Article 361 (2)”.
However, Sibal said while the SIT was seeking the direction, the High Court “changed its mind” and quashed the FIR on grounds of immunity which “possibly cannot be the interpretation of Article 361 (2)”.
The senior advocate said the information divulged by people in high posts associated with Vyapam revealed that Yadav allegedly recommended names of five people who resorted to unfair means in the examination for forest guards.
