Amicus curie declines fee for defending Kasab

Raju Ramachandran, amicus curie in the Supreme Court for defending Ajmal Kasab, does not want remuneration for his work and has asked the court to donate it to some needy litigant.

His junior Gaurav Agrawal, too, also said he does not want fee for his work. They told this to the Supreme Court on Monday through an application.

Ramachandran in his application to the court said that while he is deeply grateful that the court has ordered remuneration, the amount may be paid to the Supreme Court or Maharashtra Legal Services Authority or any other body which can help the poor and the needy.

Supreme Court, while confirming death sentence for Kasab last week, had ordered for the remuneration to be paid to Ramachandran and his junior.

‘We direct the Maharashtra government to pay a sum of Rupees eleven lakh (Rs.11 Lakhs) to Raju Ramachandran and Rupees three lakh fifty thousand to Gaurav Agrawal (Rs 3.5 Lakhs) as token remuneration for their very valuable assistance to the court. The payments should be made within two months from on Monday,’ the court had said in its order.

Talking to Millennium Post, Agrawal said, ‘Amicus curie is appointed by the court and in the Supreme Court we follow the practice of not accepting remuneration for the work as amicus curie. We donate it to help the needy people or litigants.’

The Supreme Court, in its order, had also praised Ramachandran and Agrawal as well as Gopal Subramanium, who was representing the prosecution with assistance from Ujjawal Nikkam, the Spl. PP who conducted the trial and a team of juniors.

It said, ‘In the course of the hearing of the case, which was spread over 13 weeks, not once were the voices raised, not once was the Counsel of the other side interrupted and contradicted on a statement of fact. In my twenty years on the bench I have not heard a serious case debated in such a congenial atmosphere as created by Mr. Subramanium and Mr. Ramachandran in this case.’

After the court’s verdict on Kasab, Ramachandran had said, ‘I bow down to the court verdict.’

Ramachandran was appointed by the apex court to defend Kasab after several lawyers had declined to take up the case of Kasab in the court. He was also amicus curie in the Supreme Court in Zakia Jafri’s petition seeking a probe against Gujarat Chief Minister Narendra Modi and 62 others in Gulbarg Society massacre during the 2002 riots.
