Allahabad HC orders demolition of projects in 3 Gr Noida villages

In a major setback to thousands of flat owners and home buyers , the Allahabad high court on Monday ordered demolition of residential and commercial constructions undertaken by realty majors Supertech, Amrapali and others in three villages of Greater Noida. The court, in its order, said that all constructions done on nearly 43,000 <g data-gr-id="49">sq</g> metre land in these three villages were illegal and set a two-month deadline for them to be razed. The decision sent shock waves across the real estate market in the National Capital Region (NCR) and exposed irregularities by builders while executing realty projects.

Allahabad high court was hearing a petition filed by Jan Kalyan Trust demanding <g data-gr-id="75">removal</g> of these constructions. The petition states that these constructions were carried out on land belonging to village societies, ponds, grazing land and cremation grounds. <g data-gr-id="74">High</g> court ordered the Gautam Buddh Nagar district administration to demolish the constructions on 2,000 square meter area in <g data-gr-id="53">Patwadi</g> village, 35,000 <g data-gr-id="54">sq</g> meter in Tuglaqpur village and 6,000 <g data-gr-id="55">sq</g> meter land in <g data-gr-id="56">Itaihara</g> village. <g data-gr-id="57">Amarpali</g> has construction work in <g data-gr-id="58">Ithera</g>, Jagat Taran’s project is underway in Tughlakpur and Supertech’s project is in <g data-gr-id="59">Patwadi</g> village. The  projects were built on cremation area and were deemed illegal by the High Court as they are flouting building norms.

Dushyant <g data-gr-id="60">Naagar</g>, convenor of Kisan Sangharsh Samiti (KSS), said that following the irregularities, the trust had approached the authorities to quash the land acquisition. “These lands belong to <g data-gr-id="61">gram-sabhas</g> hence their land use cannot be changed. The builders even raised buildings on graveyards and protected zones. First we approached SDM of the area, then went to higher authorities but our efforts went in vain. Last year, we decided to move the court which has given a strong verdict. With the court ruling the nexus between builder lobby, officials and banks have been exposed again,” said <g data-gr-id="62">Naagar</g>.

The office bearers <g data-gr-id="50"><g data-gr-id="86">of of</g></g> Noida Extension Flat Owners <g data-gr-id="87">Association,</g> expressed shock and said it was a lot for them to process at the moment. They further cited concerns of  common people who had invested in the property and bought it after paying big amounts. “People were paying loans and its EMIs for five years now and questioned what were the authorities doing till now. The association chief, speaking to a TV channel, said that the owners were kept in the dark on the legality and builders or authorities were at fault,” said <g data-gr-id="52">Indrish</g> Gupta, co-founder of the association.
