A woman found guilty of lodging a false case of abetting molestation and rape against her husband to get divorce has been spared of perjury proceeding by a Delhi court which observed that her prosecution would aggravate bitterness among the couple.
Additional Sessions Judge Virender Bhatt acquitted the woman’s husband and four of his family members of the charges of abetment of rape and molestation at the hands of her brother- in-law.
“It’s a fit case where the woman deserves to be prosecuted for setting police machinery in motion on
false information and for giving false evidence before this court... but I am informed that her husband has given consent for mutual divorce, which may not take place if her prosecution is ordered.
“I feel it is not in the interest of justice to aggravate the bitterness any further by directing her prosecution,” the judge said.
