50-yr-old woman gets three years in jail for possessing heroin

Special Judge Narinder Kumar sentenced Sumitra after holding her guilty of possessing an intermediatory quantity of drug, i.e. more than what is allowd for personal use but less than the commercial quantity, under the Narcotics Drugs and Psychotropic Substances Act.

"Having regard to the quantity of the contraband recovered from the convict, which is intermediatory, and that the accused is not a previous convict and is about 50 years of age, this court deems it a fit to sentence her for a rigorous imprisonment of three years and a fine of Rs 25,000," the court said.

After imposing the sentence, the court, however, set it off against the imprisonment already undergone by her during the trial after her arrest in January 2009 from near Sheela Cinema at Paharganj in Central Delhi.

"The period of imprisonment already undergone during investigation, inquiry and trial to be set off against the period of sentence awarded vide this judgment," the judge added.
