4 accused of dacoity planning let off

Four persons accused of planning to commit a dacoity have been let off by a Delhi court saying that there was doubt about the genuineness of the case as presented by the police.

Additional Sessions Judge Illa Rawat acquitted West Delhi residents Raja Ram, Ramesh, Pankaj and Binny Dhawan, of the charges of planning to commit a dacoity, saying the police version that the accused were hardened criminals who were planning to commit dacoity ‘was not credible’.

‘It is surprising that on one hand it is claimed that accused are hardened criminals, who were planning to commit dacoity and on the other hand, it is stated that said persons meekly surrendered to the police without making any attempt to evade arrest...All of them (police officials) deposed on almost similar lines in their examination-in-chief, however, their testimonies lack credibility...the prosecution case is full of lacunas and loopholes which by itself creates doubt regarding its genuineness,’ the judge said. The case of the prosecution dated back to 18 September 2008, when the police received a tip-off that five to six armed persons would gather near the theatre to commit dacoity.

The police had constituted a raiding party and subsequently apprehended them at a spot near the theatre.

During the trial, the prosecution had claimed that the accused persons, armed with deadly knives, were apprehended from the same spot and that the guilt of the accused had been proved beyond any reasonable doubt.
