1984 riots: SC dismisses Sajjan’s appeal

He had approached the apex court after failing to get relief from the Delhi high court and trial court, which had framed charges, including murder and rioting against him and others.
A bench headed by Justice AK Patnaik also dismissed similar pleas of other accused Ved Prakash Pial and Brahmanand Gupta in the case.
Kumar’s counsel argued that his client could not be charged under section 302 (murder) of Indian Penal Code (IPC) as there is no direct allegation of killing against him, while counsel for the riot victims said that the rioting in Sultanpuri area was at the behest of Kumar.
The high court had refused to quash charges framed against Kumar and others in the case relating to violence and killing in Sultanpuri area in the wake of assassination of former Prime Minister Indira Gandhi. The high court had also dismissed the plea of complainant Sheela Kaur, a riot victim, who had filed a cross-appeal seeking to invoke an additional charge of criminal conspiracy against Kumar and four others in the case.
In July 2010, the trial court had framed various charges including murder and rioting against Kumar, Brahmanand Gupta, Khushal Singh (he died during pendency of the case) and Ved Prakash Pial in connection with killing of a man in Sultanpuri area in the riots, which had taken place after the assassination of Indira Gandhi on 31 October 1984.
The Central Bureau of Investigation had filed two charge sheets against Kumar and others in January 2010 in the riots cases registered in 2005 on the recommendation of Justice GT Nanavati Commission which had probed the sequence of events leading to the violence.
Earlier, a lower court had acquitted Kumar in another 1984 anti-Sikh riots case. However, five other accused were held guilty for offences including murder and for being a part of the mob that killed five Sikhs at Delhi Cantonment.
