16 December gang rape: SC lifts hurdles for juvenile verdict

The Supreme Court on Thursday cleared the way for announcement of verdict by the Juvenile Justice Board (JJB) in the role of a minor in 16 December gang rape case. The verdict in the case had been deferred four times by the JJB in view of a pending petition in the apex court seeking fresh interpretation of the term juvenile. On the last date, the JJB had deferred the announcement of verdict till 31 August.
The apex court had reserved its order on the maintainability of the plea of senior Bhartiya Janata Party leader Subramanian Swamy, who had sought fresh interpretation of the term. On Thursday, a bench headed by Chief Justice P Sathasivam admitted his plea but said that the JJB can go ahead with pronouncing the verdict.
Turning down the plea of the central government that Swamy’s plea is not maintainable, the court also issued notice to the central government on the matter.
‘We make it clear that it is now open for the Board to proceed further in the matter and render such orders, in accordance with law, as may be considered just, adequate and proper,’ said the court.
