A Division Bench of Calcutta high court comprising  Justice Debashis Kar Gupta and Justice  Mohammad Mumtaz Khan on Monday quashed the Howrah district court's order acquitting five accused in the Tapan Dutta murder case and ordered to examine all documents. The court further ordered to record Pratima Dutta's statement afresh. It observed that the lower court did not examine all the documents properly and did not record Pratima Dutta's statement properly. Tapan Dutta was murdered on May 6, 2011 in Bali. Dutta had resisted filling up of water bodies in different areas of Howrah.

CID filed charge-sheet against 13 persons including minister Arup Roy on  December 6, 2014.  But later, it dropped the name of Roy along with eight others in the supplementary charge-sheet. However, a case was started against five accused. But they were acquitted by the lower court. Not satisfied with the order of the lower court, Pratima Dutta filed a petition before the High Court.
