Youth gets 10-yr jail for raping minor

Additional sessions judge M C Gupta awarded the jail term to 21-year-old Jakir Malik, a resident of Nihal Vihar here, while dismissing his submissions that he was being implicated in the case.

‘The testimony of prosecution witness one prosecutrix (victim) on careful perusal and analysis is found to be clear, natural, cogent, convincing, trustworthy and inspiring confidence.

‘The version of this witness on the core spectrum of the crime has remained intact. There is nothing in her statement to suggest that she had any animus against the accused (Malik) to falsely implicate him in the case,’ the court said and also imposed a fine of Rs 20,000 on him.

According to the prosecution, Malik had on 2 February, 2011 kidnapped the 12-year-old girl, while she was on her way to school. Malik took her to a room in Nihal Vihar and raped her. It said the father of the minor had lodged a missing complaint at a police station here on 2 February, 2011, saying his daughter had left the house to go to school but she did not reach there.

In his complaint, he suspected that his daughter might have been enticed by Malik. During the probe, the minor and Malik were recovered by the police at Hathras Railway Station in Uttar Pradesh.

During the trial, Malik claimed that he has been falsely implicated in the case. The court, after going through the evidence produced before it and statement of the witnesses, held Malik guilty.
