A compensation of Rs 33.47 lakh has been awarded by a Motor Accident Claims Tribunal (MACT) to an office-goer who suffered partial disability in his left leg in a road accident two years ago.
While computing the compensation, MACT presiding officer Arun Bhardwaj also included the cost of a second hand car and a driver considering that ‘the claimant would not be able to use public transport or drive a car or a motorcycle on his own for the rest of his life’.
‘... A sum of Rs17,71,660 is also awarded to the claimant for engaging a driver cum attendant,’ he said.
‘This fact cannot be ignored that due to this disability, the claimant will not be able to travel in public transport for going to his office.
‘The claimant will not be able to drive any motorcycle or car on his own for the rest of his life. If the claimant has to continue his job, he will have to buy a four wheeler and engage a driver for taking him to office,’ the Tribunal said.
It also included the salary which would be payable to the driver of the car and also made provisions for revision of his wages.
The insurance company TATA AIG Insurance has been asked to pay the amount in 30 days.
The compensation was awarded to ShibuVPilla, 40, who was working as Assistant Manager in a private company. He told the court that on 27 October, 2011, he was going from his office in Gurgaon on his motorcycle and at around 6 pm when he crossed Dwarka underpass, he was hit by
the offending vehicle being driven in a rash and negligent manner.
The Tribunal noted that in another criminal case, the driver and owner of the vehicle had pleaded guilty to driving negligently.
The compensation also included loss of amenities, pleasure of life and his inability to attend social functions in future.
