Soon, government in Delhi again!

The move comes in face of the fact that the matter of the dissolution of Delhi assembly comes up before the Supreme Court again on Thursday. Since there is no elected leader of the BJP legislature party, the invitation could be sent to the office of state BJP president Satish Upadhyay.

The Supreme Court on Tuesday pulled up the Centre and Delhi lieutenant governor Najeeb Jung for delay in taking decision regarding government formation in Delhi. Resuming hearing on a petition filed by the Aam Aadmi Party seeking dissolution of the Delhi assembly and fresh polls, the court said, ‘In a democracy, President’s Rule can’t go on forever. Jung should have taken decision on government formation at the earliest and should not have taken five months time.’          

However, the Centre informed the court that president Pranab Mukherjee has given his consent to Delhi LG’s proposal to invite BJP to form the government in Delhi. But the five-judge constitutional bench headed by Chief Justice HL Dattu said that it will hear the petition based on the merit of the issue. The bench also questioned why the Centre always comes out with one statement or another just a day before the matter is taken up for hearing by it.

The bench said that the case was adjourned many times to facilitate the LG to take a decision but nothing was done. Referring to the president’s letter which was placed before the bench, the apex court said that the exercise should have been done much earlier and adjourned further hearing on the petition till Thursday.

Following the position taken by the government in the court, the Aam Aadmi Party and the Congress alleged that the BJP was running away from elections as defeat was staring them in the face. On the other hand, the Delhi BJP president said that the party would react only after invitation has been received by the party.
