SC to BSES: Pay up or face disconnection!

Update: 2014-07-04 00:17 GMT
The Supreme Court on Thursday ordered the Reliance ADAG-owned discom BSES to either clear the Rs 410-crore arrears payable to the National Thermal Power Corporation (NTPC) and other state generation and transmission companies by 15 July or face disconnection of supply. Earlier, the apex court had allowed NTPC, on 6 May, to cut supplies to the Reliance-Owned discom BSES (Yamuna and Rajdhani) if they failed to clear outstanding bills of Rs 700 crore by the end of May, 2014.

The Supreme Court said the company shall also continue to pay the recurring monthly demand to power generating and transmitting companies on the same basis of figure indicated in its order of 6 May, 2014. In the order, a bench headed by Chief Justice R M Lodha said: ‘We are satisfied that the discom BSES Yamuna Pvt Ltd must make payment of due amount as on 30 June.’

BSES spokesperson clarified there are no outstanding dues of NTPC. BSES Yamuna Power Limited owes Rs 161 crore to the state-run-power producers DVC, IPGCL, Aravali and Delhi Transco Limited. ‘BSES Rajdhani Power Limited has paid all agreed dues as on 30 June, 2014,’ added BSES spokesperson. The bench, which took on record the statements of accounts shown to it, said: ‘The company will make the payment as shown to generating and transmission companies immediately and in no case later than 15 July, 2014.’

The bench comprising Justices M B Lokur and Kurian Joseph noted there were no admitted statements of dues about BSES Rajdhani Power Ltd. However, the bench was told that BSES Rajdhani has already paid 94 per cent of the outstanding dues. The bench, which posted the matter after two months, said other diverse issues arising in the matter will be taken up later. BSES Yamuna has 13.5 lakh customers in central and east Delhi, including Chandni Chowk, Daryaganj, Paharganj, Shankar Road, Patel Nagar, Krishna Nagar, Laxmi Nagar, Mayur Vihar and Yamuna Vihar. BSES Rajdhani distributes power to over 18.5 lakh consumers in south and west Delhi, including Alaknanda, Vasant Kunj, Saket, Nehru Place, Nizamuddin, Sarita Vihar, Hauz Khas, R K Puram, Janakpuri, Punjabi Bagh, Tagore Garden, Vikas Puri, Palam and Dwarka.
