Road mishap victim’s family gets Rs 1.53 cr compensation

The Tribunal directed New India Assurance Company Ltd, with which the truck was insured, to pay Rs 1,53,04,188 compensation to the wife, two children and the mother of 39-year-old Nikhil Mehta who died in the accident in April 2011.

‘From over all facts and circumstances, it is clear that the accident was caused at around 4 am when it was dark and the truck was found standing on the highway, this act itself is rash and negligent, thus the petitioner has been able to prove that the accident was caused due to rash and negligence act of respondent no. 1 (truck driver),’ MACT Presiding Officer Ajay Kumar Jain said. In the petition, Mehta’s family said that the accident had taken place at around 4 am on 22 April, 2011 when they were going to Himachal Pradesh in a car, driven by the victim’s brother.

On reaching a village in Punjab’s SAS Nagar district, they found that an overloaded truck was wrongly parked in the middle of the road without any indicator or blinking spot light and their car struck the right side of truck.

Due to the impact, Mehta, a resident of Jangpura here, suffered grievous injuries and was taken to a hospital where he was declared brought dead by the doctor.
