Police book woman for making anti-Modi comment on Facebook

According to sources in the police department, a case was registered at the Jama Masjid police station in central Delhi on 16 November. The source, however, refused to divulge more information.

The accused has been identified as Shiba Aslam Fahmi, a resident of the Jama Masjid. Fahmi reportedly lives in the area with her husband. The court’s order came after Fahmi got a case registered against a man named Pankaj Kumar Dwivedi for allegedly posting some threatening comments on her Facebook update in which she criticised Modi in 2012.

In her complaint to the police, Fahmi alleged that Pankaj posted a threatening comment, while replying to her Facebook update.

However, during the proceedings the Tis Hazari Court not only discharged Pankaj from charges under Section 66A of Information Technology Act, but went ahead and ordered the Delhi police to register a case against Fahmi for her Facebook update. The court said that her update was capable of hurting religious sentiments.  The order was given by the court in October this year.

Police said that Fahmi has held Modi responsible for the 2002 Gujarat riots and has questioned the involvement of state police. As per the FIR, Fahmi has mentioned in her Facebook update that the 2002 riots were well planned and executed by Modi.

In her update, Fahmi also accused Gujarat police of helping Modi orchestrate the riots. Later, in the month of November, Delhi police finally registered a case against Fahmi with Jama Masjid police station.

She has been booked under section 153A (promoting enmity between different groups on ground of religion, race, place of birth, residence, language, etc, and doing acts prejudicial to maintenance of harmony), 153B (imputations, assertions prejudicial to national integration) and 295A (deliberate and malicious acts, intended to outrage religious feelings of any class by insulting its religion or religious beliefs) of the Indian Penal Code.

Police said that Fahmi has not been arrested so far as further investigations are underway.
