Man tries to kill wife with axe, lands in jail

A 40-year-old man has been sentenced to four years in jail by a Delhi court for attacking his second wife with an axe and trying to kill her.

District Judge (DJ) O P Gupta handed down the jail term to North West Delhi resident Tarun Kant saying he has shown no sign of ‘repentance’ after his first wife left him due to the regular physical torture and beating by him.

‘I have given my due consideration to the arguments and feel that punishment must have the effect of deterrence. The accused (Tarun) has shown no sign of repentance.

‘His past acts of beating the present wife and previous wife who was divorced, get revived to call for stiffer sentence,’ said the judge, while also imposing a fine of Rs 5,000 on Tarun.

The FIR in the case was lodged on his wife’s statement to the police that on 19 December 2010 night, Tarun had tried to kill her with an axe, but she had managed to escape after her father-in-law intervened.

Tarun, who was out on bail, was taken into custody in April this year after charges were framed against him for attempting to kill his wife.

Seeking leniency, Tarun’s counsel had said the convict is a middle-aged person of 40 years and he ‘could not have gained anything out of attacking his wife and he had no previous involvement.’

Brushing aside the counsel’s submissions, the court said the act of the accused was barbarous as ‘he attacked his own wife with a dangerous weapon on head and mouth. He repeated the attack and committed the offence in a cold-blooded manner.

‘He had already made a preparation. The victim remained admitted in hospital for one month. On earlier occasion also Tarun had damaged an ear drum of the victim. So he deserves to be punished severely.’

The court had also relied on deposition by Tarun’s father and said, ‘It is very rare that the father of an accused deposes against him.’

During investigation, Tarun’s father had told the police that his son got married in November 2004 and it was his second marriage.

‘Accused used to beat his first wife, so she got separated from him due to fault of his son. However, he got married to another girl and had one minor son.

‘Accused is in the habit of taking liquor and quarrelling with his wife regularly,’ the father had told the police.

He had also said the accused and his second wife were having strained relation since soon after their marriage. The court also observed that Tarun had committed the act with ‘preplanned mind.’
