Man cheating on pretext of jobs gets a year in jail

A year’s jail term awarded to an ayurvedic practitioner for allegedly cheating a man on the pretext of getting him a job with a fixed salary in Delhi Metro has been set aside by a Delhi court. Additional Sessions Judge (ASJ) Anju Bajaj Chandna let off North Delhi resident Satyawan Pawar, saying there was no dishonest inducement on his part and no case of is made out against the accused.

‘No dishonest inducement on the part of accused is made out. It is only that accused provided the services to the complainant and got him a job with Delhi Metro at the post of helper and accordingly amount was paid by the complainant.

‘There is no dishonest inducement on behalf of Pawar and hence no cheating is made out...The accused is acquitted under section 420 (cheating and dishonestly inducing delivery of property) of the Indian Penal Code,’ the ASJ said.

The sessions court’s order came on Pawar’s appeal against the magisterial court’s decision convicting him for allegedly cheating complainant Yogesh Kumar and making him pay Rs 25,000 for a job as a helper in the Delhi Metro Rail Corporation.

Kumar had alleged in his complaint against Pawar that the accused had informed him that salary for the position of a helper is Rs 4,200 and that he had paid Rs 25,000 to the ayurvedic doctor in April 2004 for arranging the job.
