Family members of a 30-year-old man, who died in a road accident involving a rashly driven truck here, have been awarded a compensation of over Rs 10 lakh by a Motor Accident Claims Tribunal (MACT) here.
The tribunal directed the Oriental Insurance Company, with which the offending truck was insured, to pay an amount of Rs 10,28,152 as compensation to the wife and parents of Roop Kumar, who was riding a motorcycle when a rashly driven truck mowed him down in 2008.
“In view of testimonies of the victim’s mother and certified copies of criminal record produced, no doubt is left in respect of the deceased having suffered injuries in road accident due to rash and negligent driving of the vehicle (truck),” MACT Presiding Officer Barkha Gupta said.
The order was passed ex-parte as the driver and the owner of the truck were not present, while the insurance company filed a written statement contending that it was the victims negligence that led to the accident.
The insurance company had also claimed that the driver was not holding a valid driving licence at the time of the accident.
The tribunal rejected the contention of the insurance company about victim’s negligence but allowed it to recover the compensation money from the driver and owner of the truck for driving without a licence.
According to the petition, on September 18, 2008, victim Roop Kumar was crossing Palam Vihar on his motorcycle, when a truck came from the side of Gurgaon at a very high speed in a rash and negligent manner and hit him. Due to the impact, the victim got dragged by the truck for a considerable distance and sustained severe injuries. He was admitted in hospital, but succumbed to death.
