HC quashes govt guidelines on nursery admissions

The Delhi High Court on Friday allowed private schools in the city to set up their own guidelines for nursery admissions regarding general category seats.

The High Court said the power to decide the school of a child should lie with the parents. “Position on map cannot decide which school a child should go to,” it added. Justice Manmohan also restrained Delhi government from issuing fresh notification for nursery admission for the upcoming academic year in the national Capital on a plea challenging last year’s guidelines.

Quashing Delhi government’s guidelines in the matter, the court said, private unaided schools should have administrative autonomy to decide on admissions. It said administrative autonomy of the schools cannot be restrained by way of office orders.

The Court was hearing petitions filed by parents challenging the guidelines issued by Delhi government last year. It said power to decide school of a child should lie with the parents.

The parents of the children seeking admission in nursery classes had horrendous time as the government took several months to decide on the admission norms last year, which repeatedly invited litigation needing court’s intervention.

Under the earlier system, out of a total 100 points, 70 were given if the child lives in the neighbourhood of the school, additional 20 were given if a sibling is studying there, five points more if either parent is an alumni and another five points if it is an inter-state transfer case. Draw of lots were held at each point level.
