Court dissolves marriage due to man’s cruel conduct

The plea of a young woman for dissolution of her marriage on grounds of cruelty has been allowed by a Delhi court, which said her husband and in-laws were blinded by ‘endless greed’ for money and dowry and they even ignored basic standards of humanity.

Additional sessions judge Sujata Kohli said the woman’s husband, a divorcee, and her family tortured her mentally, physically as well as with their harsh words and there was no reason why she should continue with such a matrimonial relationship.

‘Blinded by the endless greed for money and dowry, the respondent (man) and his family even ignored the basic minimum standards of dignity and humanity. There is no reason why the petitioner (woman) should be expected to endure with a matrimonial bond which had no meaning or value for the man.

‘The petition is decreed in favour of the woman holding that the marriage between them... is hereby dissolved,’ the court said, proceeding against the man ex-parte as he chose not to appear despite repeated attempts.

The court said it was clear from several incidents that the man did not even consider his wife as a human being having sentiments and emotions like any young newly married woman. ‘The inhuman remarks made by the man against the mother of the woman crossed all limits of behaviour.

‘The man described the woman’s mother as “your old rusty good for nothing mother who died without giving the money for air conditioner and Maruti Swift car”, and that is why “I banished you from my home”,’ it said.

The woman said at the time of marriage it was concealed from her that her husband was already a divorcee and when she confronted him, he threatened to kill her if she disclosed the fact to anyone.
