Convicted for shooting mosque’s head, 3 let off

Three men, convicted for trying to kill the former president of a mosque by opening fire at him, have been sentenced by a Delhi court to around 15 months of jail term already undergone by them during trial and let off.

Additional Sessions Judge Sanjeev Kumar released Delhi residents Mohsin Saifi, 28, Mohammad Farooq, 54 and Sartaz, 35 after the victim told the court that he has forgiven the trio and has no objection if leniency is shown to them.

‘The convict Mohsin has fired the bullet on the head of complainant Mohammad Tahir and injured him. Thus, he has attempted to commit his murder.

‘This offence is very grave, but as Tahir has compromised and forgiven him and the fact that he remained in judicial custody for approximately 15 months,... I take lenient view and sentence Mohsin for the period of jail term already undergone by him,’ the court said, also imposing a fine of Rs 10,000 on him.

The court also directed Mohsin to pay a sum of Rs 2 lakh as compensation to Tahir. The court showed leniency to Farooq and Sartaz, saying that they had only exhorted Mohsin to fire at Tahir, who had forgiven them as well. The court imposed a fine of Rs 10,000 on each while also asking them to pay Rs 50,000 each to Tahir.

The prosecution said Tahir was shifted to the BSA Hospital here after he sustained bullet injuries in his head.

It further said after Tahir gained consciousness, the police had recorded his statement and had lodged an FIR against the four persons.

The court, however, acquitted fourth accused Sagir saying the complainant did not name him in his statement to the police.

The prosecution had also said Tahir was the then president of the mosque and accused persons wanted to remove him from that post and on that account they had threatened him and when he had refused to resign, they had shot him.
