COMPAT upholds CCI order in AAI bollard case

The Competition Appellate Tribunal has rejected a plea challenging a CCI order which had cleared the Airport Authority of India (AAI) of charges of abusing dominant position in tendering of tyre killers and bollards.

Upholding the Competition Commission of India's (CCI) decision, the tribunal said that AAI was not a 'dominant purchaser' of tyre killers and bollards and thus has not 'abused its dominance' in the award of a tender.

'There is no merit in this appeal and we dismiss the same,' the three-member COMPAT bench said on the petition of Kanazia Digital Systems against the CCI order. AAI had floated a tender for procurement and installation of tyre killers and bollards at five airports in 2010.

According to Kanazia Digital, which had participated in the tender with French company Aximum, AAI using its dominant position imposed unfair conditions on companies participating in the tender.
