Besides them, the court also framed charges against former Jharkhand Chief Secretary Ashok Kumar Basu, two government servants, Basant Kumar Bhattacharya and Bipin Bihari Singh, Vini Iron and Steel Udyog Ltd (VISUL), its director Vaibhav Tulsyan, Koda's alleged close aide Vijay Joshi and chartered accountant Navin Kumar Tulsyan.
Special CBI Judge Bharat Parashar framed charges against these nine accused for alleged offences punishable under sections 120-B (criminal conspiracy) read with 409 (criminal breach of trust by public servant) and 420 (cheating) of IPC and under relevant provisions of Prevention of Corruption Act.
"In terms of order dated July 14, charge for the offences under section 120-B and under section 120-B read with sections 409/420 IPC and 13(1)(c)/13(1)(d) the PC Act has been framed separately against all the accused i.e. M/s VISUL, H C Gupta, Basant Kumar Bhattacharya, Bipin Bihari Singh, Ashok Kumar Basu, Madhu Koda, Vijay Joshi, Vaibhav Tulsyan and Navin Kumar Tulsyan....," the court said. The court framed the charges after the accused did not plead guilty and claimed trial in the case relating to coal block allocation Rajhara North (Central and Eastern).
The court has now fixed the matter for August 17 for admission and denial of documents by the accused.
"Accordingly, the matter be initially listed on August 17 for admission and denial of documents by accused Basant Kumar Bhattacharya, Bipin Bihari Singh, A K Basu and Madhu Koda. As regard accused Navin Kumar Tulsyan, Vaibhav Tulsyan and H C Gupta, admission/denial of documents shall take place on August 18 and qua accused M/s VISUL and Vijay Joshi admission/ denial of documents shall take place on August 19," it said.
The plea for admission and denial of documents was moved by CBI and the court fixed three dates for it considering the voluminous nature of documents and number of accused.
"However, immediately after the conclusion of exercise of admission/denial of documents, dates of recording of prosecution evidence shall be fixed on August 19," it said.
The court had earlier said that Gupta also prima facie committed offence under section 409 of the IPC while Vaibhav Tulsyan, Joshi and VISUL had prima facie committed offence of cheating.
On July 14, the court had ordered to put these accused on trial observing that various acts of omission and commission committed by them prima facie made it clear that they had conspired with a "sole objective" to accommodate VISUL in Rajhara North (Central and Eastern) coal block in Jharkhand.
Coalgate: Darda, 6 others summoned as accused
Rajya Sabha MP Vijay Darda, former Coal Secretary H C Gupta and five others were on Friday summoned as accused by a special court which took cognisance of CBI's final report filed in a coal block allocation scam case. The court also summoned two senior public servants K S Kropha and K C Samria, M/s JLD Yavatmal Energy Pvt Ltd, its Director Manoj Kumar Jayaswal and Vijay Darda's son Devendra Darda as accused in the case. The court summoned these accused for August 20 for the alleged offences under section 120B (criminal conspiracy) read with 409 (criminal breach of trust by public servant) and 420 (cheating) of IPC and under relevant provisions of the Prevention of Corruption Act. "I proceed to take cognisance of the offence under section 120B of IPC and that of offences under sections 120B read with section 409/420 of IPC and section 13(1)(c)/ 13(1)(d) of PC Act against the accused persons," Special CBI Judge Bharat Parashar said.
Ex-Coal Secy summoned
Former Coal Secretary H C Gupta and four others, including two senior public servants, were today summoned as accused by a special court here in a case of alleged irregularities in allocation of Mahuagarhi coal block in Jharkhand.
Besides Gupta, Special CBI Judge Bharat Parashar summoned senior public servants — K S Kropha and K C Samria — M/s Jas Infrastructure Capital Pvt Ltd (JICPL) and its Director Manoj Kumar Jayaswal as accused in the case for August 20.
