Civil Rights group writes to deputy CM, reminding of failed appeal

Social Jurist, a Civil Rights group wrote a letter to Delhi Deputy Chief Minister reminding him that the Government has failed to file an appeal against the Single Judge Judgment of Delhi High Court, absolving all unaided minority schools on government lands of their obligation to admit economic weaker section(EWS) students.

The High Court of Delhi, through Justice Manmohan, in its judgment dated September 1, 2014 has absolved the minority schools in Delhi, which stand on the government lands allotted to them on concessional rates of their obligation to admit students from EWS category in all classes and grant them free-ship, notwithstanding any condition in their allotment letters requiring them to do so.

The judgment is a severe blow not only to the rights of the EWS students in Delhi, but also to the State, which had allotted lands to such schools at throw-away rates in good faith with the expectation that these institutions would serve the public good. It is indeed a case of butchery of
common good for commercial gains.

“Before parting with this case, we think it appropriate to observe that it is high time the government reviews the entire policy related to the allotment of land to schools and other charitable institutions. In cases where public property is being given to such institutions practically for free, stringent conditions have to be attached with respect to the user of the land and the manner, in which schools or other institutions established thereon shall function,” the letter by Social Jurist said.
