CBI had earlier decided to close the case against these two companies but on orders from the Supreme Court, the agency had to submit all papers to the CVC which was asked by the apex court to verify the reports and whether a correct decision had been taken.
In these two cases, the CVC gave an oral order reasoning registering a case against the two firms whereas in other 12 cases, the Vigilance Commission had merely asked them to register a case without assigning any reason.
CBI will be informing the Supreme Court tomorrow and seek necessary directions in the matter when the matter comes up for hearing.
In Thursday’s development, the companies whose directors and promoters were booked and named in the FIR are Ranchi-based DOMCO Smokeless Fuels Pvt Ltd (its directors Krishna Murari Poddar, Padam Prakash Gupta, Binay Prakash, Vasant Diwakar Manjrekar, Kailash Ajitsaria) and Raipur-based Vandana Vidyut Ltd (its directors Vinod Agrawal, Prahlad Kumar Agrawal and Vijit Agrawal).
Several raids were conducted by the investigating agency in Ranchi, Chhattisgarh and New Delhi before charging them with criminal conspiracy (section 120 B IPC), cheating (section 420 of IPC) and criminal misconduct (Sec 13 (1) (a).
‘DOMCO Smokeless Fuels Pvt Ltd entered into a conspiracy with some unknown people and submitted false information with dishonest intention to the authorities while applying for a captive coal block and secured allocation of the Lalgarh (North) coal block.
The director of the company allegedly gained pecuniary benefit of Rs 7 crore by selling shares of the company on premium, after the allocation of the coal block,’ a CBI official said.
Meanwhile, the Vandana Vidyut Ltd. (also known as Vandanaa Group) was booked after it was found that they were involved in mischievous activities to get the Fatehpur East coal block.
‘We have found that the members of the 35th screening committee on coal block allocation deliberately did not follow the guidelines and showed undue favour to Vandana Vidyut Ltd. They along with others have also been named in the FIR,’ CBI sources said.
With these two fresh cases, the CBI has till now registered 20 FIRs and five preliminary inquiries in coal block allocation cases, out of which it has filed closure reports in four FIRs and two chargesheets.
