Case registered against 7 officials of Orchid Infrastructure for cheating

The Gurgaon Police have registered a case against seven officials of the Orchid Infrastructure Developers — including a MD of another group housing company for allegedly cheating home buyers and for making false representation of the properties to extract money from buyers. The builders have also been accused of changing the layout plan of the building without having proper approvals from the Department of Town and Country Planning.

According to the police, as many as 100 home owners in their complaint have alleged that the builder falsely lured them by putting out misleading advertisements of their group housing project in Gurgaon’s Sector 51.

Listing out their grievances in the complaint registered at Sadar police station, the FIR read: “The complainants after taking the possession were shocked to know that the society was not gated as promised by the accused persons…That the accused persons with dishonest intention made false representation to extract money from the complainants… That the accused further cheated the complainants because as per the layout plan there is a park for the society flat owners but surprisingly without informing the flat owners and even without having proper approvals from the competent authorities this park has now been converted into electricity plant with huge diesel generators and electrical panels installed there.”

Along with basic amenities that group housing owners should get, the buyers have also alleged that during the time of possession of these flats in the year 2013-14, the builder told them that during construction, the size of the plots had increased and charged around Rs 150 crore as a total money from each home owner for their increased size of the plot. “However, in the occupation certificate from the Department of Town and Country Planning — which is given once the building is completed and the handing over of plots is completed — the sizes of the plots are shown smaller,” said Rajinder Kumar, counsel for the aggrieved home buyers.

Home buyers have also alleged that at some housing units where construction work is still on, builders have managed to get occupation certificates issued for such units even before the actual completion of construction work. “The accused person managed to take occupation certificate without electricity and water connection and without completing the construction. The builders have not complied with the provisions of the Haryana Apartment Ownership Act 1983,” read the complaint.

The accused — MD of Orchid Developers Infrastructure private limited, MD of Shetal International Pvt Ltd, Ajay Goel, Savita Srivastava, Pankaj Bijuria, Rajeev Gupta, Subhash Sharma have all been booked under Sections 120B, 278, 406, 420, 467, 468, 471 of the IPC.
