Chandrakeshwar Prasad alleged that his life was in danger after the release of Shahabuddin, who was earlier convicted for the murder of his two sons. He filed the appeal on the ground that the strongman-turned-politician would misuse his liberty to derail the trial in the murder of his sons.
The Patna high court had released Shahabuddin as the trial in the case of the murder of Chandrakeshwar Prasad’s third son has not yet commenced.
The Bihar government had been facing flak over Shahabuddin’s release from jail earlier this month following his bail.
On Wednesday, Janata Dal(U), part of the ruling coalition in the state, had said that the Nitish Kumar government may soon file an appeal in the Supreme Court.
“This has been an established process followed by Nitish Kumar government in the past 11 years that if the state is not satisfied with the bail of somebody, it goes in appeal in higher court,” JD(U) spokesperson Ajay Alok said.
“It has been done in the past and would be followed in the present case of Shahabuddin too,” he said.
Shahabuddin was in jail for 11 years in connection with dozens of cases against him and was granted bail on September 7.
