RSP MP gives notice for Privilege Motion against Rev Secy Adhia

RSP member N K Premchandran has given notice in Lok Sabha for Privilege Motion against Revenue Secretary Hasmukh Adhia, alleging that he had given out an information which was to be notified after passage of the Income Tax amendment bill introduced in the House on Monday.

The MP from Kerala has given notice for Breach of Privilege under Rule 222 of Rules of Procedure and Conduct of Business. The notice is under consideration of Speaker Sumitra Mahajan. 

Premachandran said that the Taxation Laws (Second Amendment) Bill, 2016, introduced by Finance Minister Arun Jaitley in the House on Monday, has a provision empowering the Government to notify the last date applicable for depositing the black money in Taxation and Investment Regime for Pradhan Mantri Garib Kalyan Yojana 2016 and Pradhan Mantri Garib Kalyan Deposit Scheme 2016.

The provision empowering the government to notify the last date is in Section 199(C) of the bill, he told media.

“The bill is pending before the Lok Sabha for discussion and decision. No authority other than the Lok Sabha is empowered to take a decision and declare the same outside the House,” he said.

However, on Monday, Adhia briefed the press and stated that “the last date for availing the benefit of disclosure is likely to be December 30”, the MP said.

“A declaration regarding the matter pending before the House amounts to breach of privilege of the House. The Revenue Secretary has given indication to black money holders for sufficient preparation to save their money that too with respect to a matter pending before the Lok Sabha for consideration,” he charged.
