Man acquitted for lack of witnesses

A man facing trial for allegedly hurting policemen during a drive against flesh trade has been let off by a Delhi court on the ground that the prosecution failed to rope in public witnesses in the case.

Additional Sessions Judge (ASJ) Gurvinder Pal Singh acquitted Delhi-resident Adil Khan in the case of 'voluntarily causing grievous hurt to deter public servant from his duty,' giving the accused benefit of doubt.

Police had told the court that they had laid a trap to arrest Khan after receiving a tip-off that he was running a prostitution racket with 'John and Erick' massage parlour as his front.

The court, however, acquitted him saying that the police failure to rope in witnesses from hotel and procure CCTV footage from hotel cast doubt on the prosecution's story.

The prosecution said on 26 February 2005, the Crime Branch had received information regarding the prostitution racket. A team, led by Kumar Gyanesh, Assistant Commissioner of Police, was constituted to trap the accused.

The prosecution told the court that a policeman, posing as a customer struck a deal for company of a girl at a rate of Rs 5,000 per hour. The girl met him at the hotel lounge and then she called up accused Adil Khan to come to the hotel to collect the money from the customer.

Some time later, the girl took the decoy customer outside the hotel's porch and asked him to give the money to Khan sitting in a car, the prosecution said. As the decoy customer proceeded towards the car, he also signalled other policemen to nab Khan, who, stepped on the accelerator of his car and tried to speed away, hitting some policemen and injuring them in the process.

He also allegedly hit a police van, parked at the hotel's gate and damaged it, besides injuring policemen sitting inside the vehicle. Khan was overpowered and arrested.

The court, however, acquitted Khan saying the prosecution has failed to prove its case against the accused.

'No video footage or recordings from CCTV of the alleged occurrence were obtained from the management of the hotel to corroborate the occurrence. It adversely affects the credibility of the organiser of the raiding party, the members of the raiding party and officers of investigating agency,' the court said.
