Implementation of SC guidelines on medical negligence plaints sought

Indian Medical Association (IMA) has requested Home Minister Rajnath Singh to intervene and direct Police Heads of every State to implement the Supreme Court guidelines regarding criminal medical negligence complaints against doctors.

The guidelines issued by Supreme Court in the case of Martin F D’ Souza vs Mohd Ishfaq, stated that private complaint may not be entertained unless the complainant has produced prima face evidence before the Court in the form of a credible opinion given by another competent doctor to support the charge of rashness or negligence on the part of the accused doctor.

It further said that the investigating officer should, before proceeding, should obtain an independent and competent medical opinion preferably from a doctor under government service qualified that branch of medical practice.
